These Terms of Use (“Terms”) form a binding agreement between you and Anytime Work Philippines Inc. (“Anytime Work”, “we”, “our”, or “us”). By accessing or using the Anytime Work mobile application or website (the “Platform”), you agree to comply with and be bound by these Terms. If you do not agree, you must not use the Platform.
1. Nature of Services
- Anytime Work operates an online marketplace that connects part-time or temporary workers (“Workers”) with businesses (“Employers”) seeking to fill short-term or flexible shifts.
- Anytime Work is not an employer, manpower agency, recruitment agency, or contracting party to any employment relationship.
- All engagements or work arrangements are made directly between Employers and Workers.
- Anytime Work does not supervise, control, or guarantee the performance, quality, or conduct of any Worker.
- Employers are solely responsible for ensuring compliance with all applicable Philippine labor laws, including the Labor Code of the Philippines and Department of Labor and Employment (DOLE) regulations.
2. Eligibility
To register as a Worker on the Platform, you must:
- Be at least 18 years old;
- Be a Filipino Citizen or a foreign national legally authorized to work in the Philippines; and
- Provide valid government identification (e.g., PhilID, UMID, Passport, or Driver’s License).
By registering, you represent and warrant that the above information is accurate and truthful.
Anytime Work may verify user identity and eligibility and reserves the right to suspend or terminate accounts that do not meet these requirements.
Employers must be duly registered businesses or individuals authorized to engage Workers in the Philippines.
3. User Responsibilities
Workers must provide accurate, current, and truthful information in their profiles and during applications.
Employers must ensure that job postings comply with Philippine labor laws, including minimum wage, work hours, and occupational safety.
Users agree not to use the Platform for illegal, fraudulent, or misleading purposes.
4. Cancellations & Administrative Fees
To maintain reliability and fairness:
- Workers: Cancelling a confirmed shift within 10 days before the start date incurs a ₱150 administrative fee. Cancelling within 48 hours, twice in a month, may result in temporary suspension or termination.
- Employers: Cancelling a confirmed shift within 10 days of the scheduled date incurs a ₱150 administrative fee per shift.
(Administrative fees cover coordination costs and disruptions. They are not punitive penalties.)
5. Payments & Commission
- Employers agree to pay for all confirmed bookings through the Platform.
- Anytime Work charges a service commission (typically 20% of Worker payout, or 15% for card payments) on top of Worker wages.
- Workers are paid their agreed hourly rate through the Platform, less any applicable deductions or service fees.
- Payments are processed in Philippine Pesos (₱) and are subject to the terms of our authorized payment processors.
6. Direct Hire / Referral Fee
- If an Employer hires or engages a Worker introduced through Anytime Work outside the Platform within 12 months of the introduction, the Employer agrees to pay Anytime Work a referral fee of ₱1,000 per Worker.
- “Introduction” includes any contact, referral, or job application made through the Platform.
- No referral fee applies if the Worker is hired more than 12 months after introduction.
- The fee must be paid within 14 days of invoice.
- Failure to pay may result in account suspension or legal collection actions.
7. Data Protection & Privacy
- Anytime Work complies with the Data Privacy Act of 2012 (Republic Act No. 10173) and its Implementing Rules and Regulations.
- By using the Platform, you consent to the collection, processing, and sharing of your personal data for legitimate business and operational purposes, as described in our Privacy Policy.
- Employers may only use Worker data for lawful hiring purposes and must delete it when no longer required.
- Workers acknowledge that their profiles and work history may be shared with Employers for matching purposes.
8. Intellectual Property
- All intellectual property rights in the Platform—including trademarks, code, design, and content—belong to Anytime Work Philippines Inc. or its licensors.
- You may not reproduce, modify, or distribute any part of the Platform without our prior written consent.
9. Limitation of Liability
- Anytime Work acts solely as a connector between Employers and Workers. We are not responsible for:
- The accuracy of job postings or Worker profiles;
- The quality, safety, or legality of any job; or
- The behavior or performance of any Worker or Employer.
- Our total liability shall not exceed the total service fees paid to Anytime Work in the three (3) months preceding the claim, or ₱500, whichever is lower.
10. Suspension & Termination
- Anytime Work may suspend or terminate accounts if users:
- Violate these Terms;
- Provide false or misleading information; or
- Misuse the Platform.
- Termination does not affect our right to collect unpaid amounts or fees.
11. Governing Law & Dispute Resolution
- These Terms are governed by the laws of the Republic of the Philippines.
- In case of any dispute, parties agree to seek amicable settlement or mediation before pursuing court action.
- All disputes shall be under the exclusive jurisdiction of the courts of Makati City, Philippines.
12. General
- Anytime Work may amend these Terms at any time for operational, legal, or regulatory reasons.
- Updates will be posted on the Platform or sent via email. Continued use constitutes acceptance.
- If any clause is found invalid, the rest shall remain effective.
- Anytime Work may transfer or assign its rights and obligations without affecting your rights.
