These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User”) and ANYTIME
WORK INDIA PRIVATE LIMITED (“Anytime Work”, “we”, “our”, or “us”). By accessing or using the Anytime Work
mobile application or website (the “Platform”), you agree to be bound by these Terms.
1. Nature of Services
- 1.1 Anytime Work operates an online technology platform and marketplace enabling businesses (“Clients”) to
- engage independent individuals (“Workers”) for short-term or flexible work engagements.
- 1.2 Anytime Work is not an employer, labour contractor, recruitment agency, or party to any employment
- relationship.
- 1.3 All engagements are entered into directly between Clients and Workers.
2. Eligibility
- 2.1 Workers must be at least 18 years old, legally entitled to work in India, and provide valid government-issued
- identification.
- 2.2 Clients must be legally capable of engaging independent contractors.
- 2.3 Users warrant that all information provided is accurate and current.
3. Independent Contractor Relationship
- 3.1 Workers act solely as independent contractors and not as employees or agents of Anytime Work.
- 3.2 Nothing in these Terms creates an employment relationship under Indian labour laws.
- 3.3 Workers are responsible for their own taxes, insurance, and statutory compliance.
4. User Responsibilities
- 4.1 Workers shall perform services competently and comply with Client site rules.
- 4.2 Clients shall ensure lawful, safe, and compliant working conditions.
- 4.3 Users shall not engage in fraud or unlawful conduct.
5. Cancellations and Administrative Fees
- 5.1 Cancellations within ten (10) days of a confirmed booking may incur administrative fees as displayed on the
- Platform.
- 5.2 Administrative fees represent genuine costs and are not penalties.
6. Payments and Service Fees
- 6.1 Payments are made in Indian Rupees (INR) through authorised payment partners.
- 6.2 Card or instant payments incur a 15% service commission.
- 6.3 Monthly invoicing (approved Clients only) incurs a 20% service commission.
- 6A. Credit Terms, Late Fees, and Suspension
- 6A.1 Credit approval is discretionary.
- 6A.2 Overdue amounts may incur interest at 1.5% per month or the maximum permitted by law.
- 6A.3 Platform access may be suspended for unpaid balances.
7. Non-Circumvention and Non-Poach
- 7.1 Clients shall not engage Workers outside the Platform within twelve (12) months without consent.
- 7.2 Breach results in liquidated damages equal to the applicable transfer fee.
8. Data Protection and Privacy
Anytime Work complies with the Digital Personal Data Protection Act, 2023.
9. Intellectual Property
All intellectual property rights in the Platform vest in Anytime Work.
10. Disclaimers and Limitation of Liability
Liability is limited to service fees paid in the three (3) months preceding the claim.
11. Suspension and Termination
Access may be suspended or terminated for violations or compliance reasons.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Courts at Indore, Madhya Pradesh have exclusive jurisdiction.
